Generally, Canadian employees (temporary or permanent) are eligible for overtime, with the following exceptions:
- Manager / Supervisor roles (People managers)
- Professional jobs, such as 'Accountant', 'Lawyer', 'Engineer', etc.
In some provinces, there are additional exceptions to overtime eligibility. IT professionals are often considered an exception and do not qualify for overtime pay - there may also be exceptions to this rule, such as if it's a more junior role such as a Helpdesk role, or if the pay rate is below a specific threshold. Some of the provinces where IT professionals are not eligible for overtime pay:
- Ontario
- British Columbia
- Alberta
Overtime eligibility varies by province, so for the most accurate rules, please go to our article "Links to Employment Standards Websites - Provincial/Federal" to refer to your provincial employment standards website.

Please note: If you are an incorporated contractor or a sole proprietor, you are not considered an employee, and therefore are not eligible to receive overtime pay. In these cases, if you work more than the standard threshold for overtime, you will continue to be paid at your regular hourly rate for all hours worked.
