You will need to complete a CPT1 form to request a ruling from the CRA. This form must be submitted to the CRA before June 30th to be applicable for the previous tax year. If the CRA rules in your favour, we will no longer deduct EI/CPP from your payments.
To complete the application, you can either download, fill out, and submit the form online with any supporting documentation needed, or you can complete the application by logging into your CRA account and selecting “Request a CPP/EI Ruling”.
Instructions to complete the form
- You are the “Worker” so please fill out your information.
- The “Date on which employment started” should be entered as the original start date of your contract as per the paperwork/contract Procom has shared with you.
- Once you have completed all required fields – sign and date the form.
- Include all relevant documents (such as your contract) and follow the instructions to email or submit the form online to the CPP/EI Rulings Division.

Once the form has been completed in full, follow the instructions provided on the form to submit it to the CRA. It's highly recommended that the following documents be submitted along with your form:
- Fully executed consulting agreement
- Sample Consultant Invoice
- Client Contact Information
It can take up to 6 weeks to get a ruling from the CRA, and a copy of the request will be sent to you and to Procom. Procom will only proceed with processing the request once we receive the ruling directly from the CRA.
EI/CPP Ruling FAQ
Q: Can I request a ruling for a “hypothetical or proposed work placement”?
No – a request for a ruling should only be submitted once you have a confirmed placement.
Q. Can we accept a ruling letter that is not addressed to Procom?
No, we can only process the ruling if the letter is addressed to Procom. Sometimes you may receive a ruling letter that does not name Procom. In this case, Service Canada could decline it, saying it could apply to another client, not specific to the work you're performing through Procom; therefore, we will not process the request if the ruling letter has only been addressed to you. Typically, a ruling letter is issued simultaneously to all parties involved, and there is rarely a delay in Procom receiving our copy. There have been some situations where the ruling officer has only issued it to the consultant. In this case, we ask that you contact the ruling officer to request that a copy of the ruling be issued to Procom.
Q. Can Procom cease deductions without the ruling?
No, without the ruling, Procom is required to make the deductions as it is a government legislated payroll requirement.
Q. How long is a ruling valid for?
There may be a timeframe noted on the ruling that aligns with the placement dates submitted with the ruling request. Rulings are valid for the duration of these dates, unless the terms and conditions of the position/contract change.
Q. Can I use the same ruling for multiple Procom placements, or is each ruling specific to each placement?
No. Rulings are specific to each placement.
